1. Introduction and Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of https://nadirakaimova.com/ (the “Site”), and any services, programs, calls, bookings, or retreats offered by Nadira Kaimova (“I,” “me,” “my”), an independent consultant and personal brand based in Colombia.
By accessing the Site, submitting a form, booking a call, registering for a program, or attending a retreat or event, you (“you,” “Participant,” “User”) agree to be bound by these Terms in full. If you do not agree with these Terms, please do not use the Site or register for any service.
2. Eligibility and Age Restriction
All services, events, and retreats offered are exclusively intended for adults. Registration, booking, and attendance are strictly limited to individuals 18 years of age or older. By registering for any service or event, you represent and warrant that you meet this age requirement. I reserve the right to refuse registration or attendance to anyone unable to verify they are 18 or older.
3. Services Offered
I offer consulting services, coaching, digital content, calls, programs, and in-person physical retreats and events (collectively, the “Services”). Details of specific offerings, including pricing, itinerary, and terms specific to an event, will be described on the relevant event or service page, which forms part of these Terms by reference.
4. Booking, Payment, and Refund Policy
4.1 Payments
By booking a service, program, or retreat, you agree to pay all applicable fees, deposits, and charges as described on the relevant booking or event page.
4.2 Non-Refundable Policy
All bookings, deposits, and service fees are strictly non-refundable, except where explicitly stated otherwise in writing on the specific event or service description page. This includes, without limitation, cancellations made by the Participant for any reason, including personal emergencies, travel disruptions, or change of mind.
4.3 Rescheduling
Any rescheduling requests will be handled on a case-by-case basis and are subject to my sole discretion, unless otherwise specified in a particular event’s terms.
4.4 Right to Cancel or Modify
I reserve the right to cancel, postpone, or modify any event, program, or retreat due to circumstances including but not limited to insufficient enrollment, safety concerns, force majeure, or operational necessity. In such cases, I will make reasonable efforts to notify Participants and offer appropriate alternatives (e.g., rescheduling or credit), at my sole discretion.
5. Health, Safety, and Physical Activity Disclaimer
5.1 Nature of Activities
Retreats and events may include physical, mental, and emotional activities, including but not limited to yoga, hiking, intensive meditation, breathwork, and other wellness practices that may involve physical exertion, emotional processing, and exposure to natural or outdoor environments.
5.2 Participant Responsibility
By registering for and/or attending any retreat or event, you expressly acknowledge and agree that:
- You are solely responsible for ensuring that you are medically, physically, and mentally fit to participate in all planned activities.
- You have a legal obligation to disclose, clearly and prior to the event, any physical or mental health conditions, medical risks, injuries, allergies, disabilities, or limitations that could affect your safety or ability to participate, or that I or event staff should reasonably be aware of.
- Failure to disclose such information releases me from liability for any harm, injury, or complication arising from an undisclosed condition.
- You are responsible for consulting with a licensed physician prior to attending, particularly if you have any pre-existing health conditions.
- Participation in all physical, emotional, or experiential activities is voluntary, and you may opt out of any activity you feel is unsafe or unsuitable for you at any time.
5.3 No Medical or Therapeutic Advice
Nothing provided as part of the Services — including guidance, coaching, or retreat programming — constitutes medical, psychological, or therapeutic advice. Services are offered for educational, wellness, and personal development purposes only and are not a substitute for professional medical or mental health treatment.
6. Assumption of Risk
You acknowledge that participation in retreats, events, and related physical activities carries inherent risks, including but not limited to risk of physical injury, illness, accident, exposure to environmental conditions, emotional distress, and, in rare cases, death. You voluntarily and knowingly assume all such risks by registering for and/or attending any event or retreat.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- I, Nadira Kaimova, along with any affiliates, contractors, venue partners, instructors, or third parties involved in delivering the Services, shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages — including but not limited to personal injury, illness, death, emotional distress, loss of property, or financial loss — arising from or related to your participation in any retreat, event, program, or use of the Site.
- This limitation applies regardless of whether such liability arises from negligence, breach of contract, breach of warranty, or any other legal theory, except where such liability cannot be limited or excluded under applicable Colombian law.
- You expressly release, waive, and discharge me from any and all claims, demands, causes of action, or liability of any kind arising out of or related to any injury, loss, or damage that may occur before, during, or after a retreat or event, except in cases of proven gross negligence or willful misconduct on my part.
- In any event where liability is found notwithstanding the foregoing, my total aggregate liability to you shall not exceed the total amount actually paid by you for the specific service or event giving rise to the claim.
- Nothing in this section is intended to exclude liability that cannot be excluded under mandatory provisions of Colombian consumer protection or civil liability law.
8. Indemnification
You agree to indemnify, defend, and hold harmless Nadira Kaimova and any associated contractors, partners, or venue operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or third-party right; or (c) your participation in any retreat, event, or Service, except where such claims arise from proven gross negligence or willful misconduct on my part.
9. Intellectual Property
All content on the Site — including text, graphics, logos, videos, and program materials — is the intellectual property of Nadira Kaimova unless otherwise stated, and may not be reproduced, distributed, or used commercially without prior written consent.
10. User Conduct
By using the Site or attending any event, you agree not to:
- Provide false or misleading information during registration
- Use the Site or Services for any unlawful purpose
- Engage in conduct that is harassing, abusive, or disruptive to other participants, staff, or the retreat environment
- Infringe upon the rights, safety, or wellbeing of other participants
I reserve the right to remove any participant from a retreat or event, without refund, in cases of conduct that endangers others or violates these Terms.
11. Communications Consent
By submitting your contact information (via forms, WhatsApp/JoinChat, or newsletter signup), you consent to being contacted regarding your inquiry, booking, or program logistics. As stated in the Privacy Policy, marketing communications will only be sent if you have explicitly opted in.
12. Disclaimer of Warranties
The Site and Services are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. I do not warrant that the Site will be uninterrupted, error-free, or entirely secure.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia, without regard to conflict-of-law principles. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts of Colombia, unless otherwise required by mandatory consumer protection law applicable to your jurisdiction.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Changes to These Terms
I reserve the right to update or modify these Terms at any time. The “Last Updated” date above will reflect the most recent revision. Continued use of the Site or Services after changes are posted constitutes your acceptance of the revised Terms.
16. Entire Agreement
These Terms, together with the Privacy Policy and any specific event or service terms referenced on individual booking pages, constitute the entire agreement between you and Nadira Kaimova regarding your use of the Site and Services.
